Right to Work Checks

All employers in the UK have a responsibility to prevent illegal working. You do this by conducting simple right to work checks before you employ someone, to make sure the individual is not disqualified from carrying out the work in question by reason of their immigration status

Home Office guidance has recently been updated in respect of employers’ right-to-work checks and, with effect from 17 May 2021, employers will have to check applicants’ original right-to-work documents where possible.

During the coronavirus pandemic, employers have been able to carry out virtual checks on an individual’s right to work in the UK, but this will not be possible from 17 May.

There is no need for employers to carry out retrospective checks on anyone who had a right-to-work check under the temporary arrangements in place between 30 March 2020 and 16 May 2021.
