Check Your Employee’s Right-to-Work

 

The UK Government will be phasing out Biometric Residency Permits (BRP) in favour of the digital E-Visa at the end of December 2024.

Biometric Residency Permits were historically used as an easy way to ascertain whether or not your employee has the right to work in the UK and if so, the card would also show the date their right-to-work ends.

As the physical BRP card is being phased out on 31st December 2024, all currently issued cards will have an expiry date of 31st December 2024 or sooner. This is NOT the date the employee’s right to work ends and instead, you need to request your employee to provide you with a Share Code.

Employees with a time-limited right to work can request a Share Code here. They will need their current BRP or their UKVI account details.

After the Share Code has been issued and sent to the employer – it can be entered here for the employer to view the right-to-work information and the date that it ends (if applicable).

Please ensure you have done this for all employees with a time-limited right to work in the United Kingdom and keep record of end dates. If you are found to employ someone who does not have the right-to-work, or their right-to-work has ended, you are liable for fines of up to £60,000 for each illegal worker.

It is the employer’s responsibility to ensure all your employees have the right-to-work in the UK, so please keep an up-to-date record for yourself to not incur any penalties from HMRC.
